Simon is being asked about Erin’s behavior at Leongata Hospital after Mushroom lunch.
Under cross-examination by Mandy, he agrees that Erin “hate the hospital” when asked about leaving for medical advice about leaving the hospital.
Mandy also tells Simon that he has “some degree of sensitivity” to the need for children to attend hospitals.
Simon agreed, saying that both his two children have past experiences in hospitals that are “difficult.”

Mandy asks Simon about his conversation with his father Don on July 30, when he was hospitalized after Mushroom’s lunch.
Mandy says at this point Don was “in a long time physically.”
“You couldn’t ask a lot of questions about what he remembers about lunch,” Mandy says.
“That’s right,” Simon replies.
Mandy told Simon that Don told Erin about a potential cancer diagnosis rather than “certainty.”
Simon says his understanding is that Don said Erin was diagnosed with cancer.
“It was unquestionable…where there was uncertainty about how to handle it.”
Mandy reiterates that Don told Simon about “suspicious diagnosis” rather than “confirmed diagnosis.”
Simon disagres and says this is very unlikely.

Mandy says Simon contacted Erin after lunch and did not ask about the “medical issues” she mentioned.
“Didn’t it be for years that Erin often complains about medical issues and thinks she’s feeling bad for a variety of reasons?” Mandy asks.
Simon replies: “Yes.”
Mandy suggests that these are unfounded. Simon says Erin told him she struggled with the heart condition that affected her sleep.
“There’s no reason not to believe it,” he says.
Simon says this requires hospitalization from time to time.
“She struggled with mental illness, postnatal depression… I think that’s true,” he says.
Mandy says in October 2021, Erin raised concerns about a patient with ovarian cancer.
“Erin has never said she has ovarian cancer,” Simon says.

Mandy turned to Erin, who invited Simon to lunch with mushrooms on July 29, 2023.
Mandy points to Simon’s evidence that Erin informed him yesterday that he had “important” medical news to share when he invited him to lunch.
“Tell this to you, Erin didn’t say “important” or “serious” words when he spoke to you that day,” Mandy says.
Simon doesn’t remember the exact words she said, but replies, “A reasonable explanation of what is important and serious is what she conveys.”
Mandy suggests that the words “important” and “serious” are not used in his police statements.
Simon does not argue against this.

Mandy starts by asking Simon about the relationship between his parents and his children.
He shows the video to court, showing Simon’s son and father Don playing in a rocket-propelled vehicle in his backyard. Mandy says it was captured on July 17, 2023, a few weeks before lunch for the fateful mushrooms.
Simon wipes tears out of his eyes, as he shows the video.

Day 3 Summary
Before today begins, here is a summary of what the ju judge heard yesterday:
1. A text message shown to the court on Thursday revealed that Erin texted Simon the night before Mushroom lunch, saying she spent “a small fortune” buying eyefillet steak for a “special meal” of Wellington beef. She said that after he refused the invitation, Simon wanted him to change his mind.
2. Simon recalled Erin having put dehydrated mushrooms in a muffin and had a “blind taste test” with her daughter. He told the court that Erin was “funny” to prefer muffins containing mushrooms, given that she doesn’t like mushrooms.
3. Ju-dean also heard details about Simon’s relationship with Erin with her parents. He told the court that Erin was particularly close to her father, Don.
4. When asked about Erin’s self-esteem, Simon said his estranged wife was “not particularly pleased with how she looked.”
“I don’t think she has high self-esteem,” he told the court.
5. Simon recalled Erin’s mixed plate collection at his Leongata home. Under cross-examination, he described her collection and said there were several matching plates and single colorful plates.

Welcome to the fourth day of the trial
Welcome to the fourth day of Erin Patterson’s murder trial.
We expect the exam to start at 10:30am. The court closes today at 1pm.
Patterson, 50, faces three counts of murder and attempted murder related to the lunch of Wellington, a beef serving at his Leongatha home in Leongata, Victoria in July 2023.
She pleaded not guilty to the charges. The defense case is that the event was an accident and Patterson had no intention of harming the lunch guests.
