NAIROBI – The hearing in the incident that challenges Vice President Rigati Gachagua’s ammo each has been postponed with further instructions from Prime Minister Martha Coomb, who is expected to enpanel new benches.
The issue was scheduled to be mentioned on Thursday, but has now been postponed to a pending order from the Supreme Court.
A bench for 3 judges led by Judge Eric Ogora has been seized on the matter.
In a notification issued by Hon. Beja Nudauk, the department’s assistant registered assistant, has been informed of the postponement.
“Please note that following the Court of Appeals’ decision filed on 9/5/2025 under Civil Appeal No. E829 in 2024, this issue has been postponed in a pending direction by the Honorable Chief Judge in line with the Court of Appeal’s decision, that it is scheduled to be mentioned in 15/05/2025,” the notice reads.
Further instructions will be provided to the parties involved in this case in time.

Last week, the Court of Appeals took office after hearing a petition challenging the removal of former Vice President Ligatigachagua, taking the decision of Vice Judge Philomenamuul on October 18, 2024, to form the bench for three trials.
The Court of Appeal further directed that the matter be mentioned to the Supreme Court, who holds an exclusive task of enpaneling the bench to hear and decide such matters.
Deputy Judge Mwilu appointed Judge Eric Ogolla, Anthony Mrima and Freda Mugambi to hear about the case. This argues that Gachagua’s legal team challenges it as unconstitutional and that only the Supreme Court has the authority to make such appointments.
