Johnny, Matthew Gordlow’s prosecutors are fighting to keep his brother’s BAC level out of the case

Prosecutors working in the criminal case surrounding the deaths of Johnny and Matthew Goudlow have asked the judge to determine that his brother’s BAC level is unacceptable as evidence.
Officials with the Salem County Prosecutor’s Office in New Jersey filed court documents on Wednesday…Gaudrow’s brothers’ addiction measurements should not be presented to the ju apprentice – they say they are “unrelated” to the charges collected against Gaudrow’s murderer, Sean Higgins.
“Several witness accounts show that the only thing that led to the clash that led to the death of Matthew and John Gaudreau was the defendant’s actions and his actions,” authorities said in Docs obtained by TMZ Sports.
They added that “the toxicology report is irrelevant and how the siblings were operating the bike on the day of the problem.”
As previously reported, Higgins’ lawyers say the toxicology report showed Johnny’s BAC was .129 and Matthew’s BAC was .134. However, Higgins’ lawyers have not yet discussed how they consider how these outcomes factors into the case.
The parties on both sides are expected to appear before the judge on April 15th, but it is unclear whether a ruling on the prosecutor’s motion will be made.

As we reported, Higgins allegedly ran through Gaudreaus on August 29, 2024… because they were riding their bikes on the road in NJ. NHL superstar Johnny was 31 and Matthew was 29.
Higgins has been hit with multiple charges in the case, including murder of a vehicle and manslaughter. In early January, he pleaded not guilty to Count.
