Eric and Lyle Menendez may stand up next Thursday to persuade the judge by responsing a hearing worthy of red…but according to their lawyers, it could be a high-risk move.
Mark Jelagos jumped on a “Two Angry Men” podcast from Van Nuiss court on Friday, earning a new victory after a victory that closed the DA’s request to put Kibosch in a hearing to resent.
Please forgive the intro to the clip – it’s piss – but in a small way, Harvey asks about his strategy. Harvey has spent some time talking to Eric and Lyle, and clearly states that he has presented himself as a persuasive man who may impress the judge.
Mark says there is a risk to summon them, as he believes the judges are giving the prosecutors free rule and appealing to resent, and he is sure the case they make is everything about the murders of Jose and Kitty Menendez. If Eric and Lyle testify, they will be mutually investigated for crime, which can be at risk and, frankly, take points.
The key to the hearing is to determine whether Eric and Lyle are in rehabilitation and whether they pose a risk to the community, but prosecutors have focused primarily on killings up until now.
Short stories… Mark isn’t only sure if he’ll call them to the stands, but perhaps he won’t make a decision until he sees how the hearing is moving forward.
