The lawyer for Race Smith, known as Kelly, Joshlyn Smith’s mother, raises doubts about the evidence of evangelical Nico Cauchy.
Smith’s lawyer, Linesh Sivnarain, argued that while a conversation between Smith and Quetzee may be taking place, his evidence is highly unlikely, by applying the warning rules, the court fails to accept the evidence on that basis and does not risk a false conviction.
This was part of the final discussion presented by Shivnaline on Wednesday, March 30, to exempt clients from the indictment of persons and trafficking arising from Joshlyn’s loss from the informal settlement of Midelpos in Sardanha Bay on February 19, 2024.
According to Coetzee evidence heard on March 12, 2025 at the Western Cape High Court sitting in Saldana Bay in August 2025, Smith allegedly revealed to him that he plans to sell his child.
Coetzee’s evidence is an important aspect of the prosecutor’s case.
