The new bill proposed in Texas can tell transgender people a state felony if they lie about their biological sex assigned at birth…and two lawmakers defend the harsh penalty.
Texas Rep. Steve Toss and Nate Schatzline joined us on Tuesday on “TMZ Live” and asked them about the proposed bill that would add a new form of fraud related to gender identity.
As Toth and Schatzline explain, the bill – Texas House Bill 3817 – says that if Texans in Texas lie to their employers about their biological sex to their state records or employers, they commit “gender identity fraud”…and they are charged with state felony.
That means Caitlyn Jenner would violate the law if she fills out the state documents in Texas and tells her she is a woman. We asked Toth and Schatzline about this scenario – do they really throw Caitlyn into prison? ! ? – And they challenged them to see why such a bill was needed in Texas.
Frankly, not many people apply to this based on the explanations these lawmakers have given us.
Toth emphasized that the bill is saying it’s not transgender against the law, but they both said being trans is a mental illness.
